1. GENERALITIES

1.1. Transactions carried out between ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. and its customers, through its online store, are regulated by the General Conditions of Sale (GCS) presented here, which apply to both the marketing of goods and the associated accessory services.

1.2. The customer who places an order with ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. , via the online store, tacitly and without reservation accepts the GTCs in force on the date of placing the order and declares, from the outset, to have prior knowledge of them. Therefore, no objection may be made to the ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. , any clause that contradicts the aforementioned conditions, except when there is express acceptance in writing by the latter.

1.3. The date of receipt of proof of payment will be considered as the date of conclusion of the purchase and sale agreement between ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. and its customers.

2. PRODUCTS

2.1. The products offered for direct sale are exclusively those listed in the online store, with the remaining products available in the wide range offered by ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. being subject to study and presentation of a project by our Technical Office, in which case the sale will be governed by the conditions set out in those same projects.

2.2. Products are limited to existing stock, and ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. reserves the right to change the range of available products at any time.

2.3. The technical specifications of the products are stated on the website. However, if there are errors in the values and/or characteristics resulting from technical or other issues beyond the control of ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. , ESCAPE IN GAMES cannot be held liable.

2.4. ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. makes every effort to ensure that the information presented is free from typographical errors. However, whenever these occur and are detected, they will be corrected as soon as possible.

3. TRANSPORTATION, DELIVERY AND ASSEMBLY SERVICES ASSOCIATED WITH THE SALE OF PRODUCTS

3.2. Unless expressly agreed by ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. , delivery of the material will be made to the address provided by the customer, provided that their facilities are located at ground level and in mainland Portugal.

3.3. However, ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. may, as an additional service and at the customer's request, agree with the customer to deliver the goods to a location that does not meet the conditions referred to in the previous paragraph, and any additional costs arising from this change will be charged to the customer.

3.4. If the unloading conditions do not comply with the conditions indicated above and the customer fails to mention this fact, provided that the goods are transported to the address indicated by the customer, the risk of the goods shall be borne by the customer.

3.5. Upon delivery, and in the presence of the carrier, the customer must check the condition of the products, as well as check whether the number of volumes received is in accordance with the volumes stated on the transport guide.

3.6. If the packaging, upon arrival at the customer's disposal, shows signs of damage or tampering, the customer must, while still in the presence of the carrier, open the packaging, check the condition of the material, and record the fact on the delivery note (if possible, also document the incident photographically). Customers must notify ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. of these facts in writing within a maximum period of 24 hours; otherwise, they risk having any claims based on this basis rejected.

3.7. This procedure also applies to non-conformities relating to any additional services provided.

3.8. By prior agreement, documented in writing, ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. may make supplies to the Autonomous Regions of Madeira and the Azores.

3.9. Likewise, ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. may, as an additional service, assemble/install the products it supplies. In these cases, there must be an express request from the customer to this effect, in response to which a quote for the costs inherent to the operation will be presented .

4. DEADLINES FOR DELIVERY AND EXECUTION OF ACCESSORY SERVICES

4.1. Upon placing an order, the customer will receive an email from ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. containing payment details. ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. will only consider the order confirmed upon receipt of proof of payment. Therefore, ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda . cannot guarantee the availability of the items until the order processing begins.

4.2. The material will be dispatched within an estimated period of 10 (ten) working days from receipt of proof of payment, except in cases of stock shortages, cases of force majeure or any other exceptional circumstances.

4.3. If one of these situations occurs, ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. will send an email informing the customer of the situation, and the customer may, in this case, and if they so wish, cancel the order by sending an email to ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. declaring this intention in writing.

4.4. In these cases, ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. ultimately undertakes to refund, in full, the amount of payment that the customer had made.

4.5. By prior agreement with the customer, ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. may make partial deliveries of orders placed, particularly when it does not have all the required products in stock.

4.6. As the delivery of materials is carried out using third party services, ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. cannot guarantee the actual delivery times of the products ordered, therefore, any delays that occur between dispatch and receipt of the order do not give the customer the right to cancel the order, nor to demand any type of compensation, for any reason whatsoever.

4.7. It is expressly understood that the deadlines communicated by ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. are merely indicative, and therefore, failure to comply with them, under no circumstances, may constitute a charge or liability for ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda.

5. PRICES

5.1. The prices in force are those displayed on the website at the time of placing the order, to be confirmed when the respective order is completed, and are increased by the amount of VAT at the legal rate in force and respective postage.

5.2. As for ancillary services, their price will be defined in accordance with what is expressed in point 3 of these General Terms and Conditions.

6. PAYMENT CONDITIONS

6.1. Commercial transactions concluded with ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. will be settled through one of the three available payment methods:

6.2. Only after ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. has received proof of payment will it consider the order to be completed and proceed with its dispatch.

7. RETURN

7.1. In the event of any non-conformity in the material received, the customer has a period of 48 hours after receiving the order to submit a written complaint and request for the return of the material to ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. . This must be accompanied by a photograph(s) clarifying what the customer considers to be non-conforming.

7.2. After receiving the complaint from ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. , it will be analyzed by the technical department in order to determine the basis for the non-conformities reported by the customer and what steps to take following the conclusions reached.

7.3. If the goods are to be returned, the customer is responsible for arranging their transportation and will be responsible for the cost. In cases where non-conformities/manufacturing defects are confirmed in the supplied material, the customer will subsequently be reimbursed for this cost by ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda.

7.4. If complaints are deemed valid, ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. will issue a Credit Note in the customer's name. The customer may choose to keep the credit open for future purchases or request settlement, in which case ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. will refund the amount previously paid by the customer.

7.5. Returns will only be accepted for material that is in perfect condition and without any alterations, together with all its accessories and related documentation.

7.6. Failure to comply with the above conditions will result in refusal to accept the return.

8. WARRANTY

8.1. Products for sale on the ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. website benefit from a 2-year manufacturer's warranty from the date of issue of the respective invoice.

8.2. To activate the material warranty, the customer must notify ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. in writing of the defect detected, accompanying this communication with photographs that prove the condition of the material, as well as a copy of the purchase invoice.

8.3. The warranty will be excluded in the following cases:

a) Abnormal, inappropriate use, or use that does not comply with the product’s technical specifications;
b) Customer negligence in the installation, storage or maintenance of the product;
c) Improper transformation and/or incorporation of other materials into the product;
d) Incompatibility with other materials.

9. DOMICILIATION

The customer accepts that, for the purposes of judicial or extrajudicial citation or notification, the agreed domicile is that which is indicated by the customer in the order.

10. APPLICABLE LAW AND COMPETENT JURISDICTION

10.1. The purchase and sale contracts concluded between ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. and the customer are governed by Portuguese law.

10.2. For the resolution of any dispute arising from the interpretation and execution of the purchase and sale contracts entered into, the competent court will be that of the registered office of ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. .

11. INDUSTRIAL AND INTELLECTUAL PROPERTY

11.1. The texts, descriptions, comments, images and illustrations that constitute the content of this website are reserved for ESCAPE IN GAMES - Know Why Formação & Outdoor, Lda. , both in terms of copyright and all intellectual property rights, for the entire world.

11.2. Therefore, in accordance with the terms of the Intellectual Property Code, its modification, reproduction, duplication, copying, distribution, sale, resale and other forms of exploitation, for commercial or non-commercial purposes, are strictly prohibited, and its use is only authorized for exclusively private purposes.
